PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION THAT AFFECTS YOUR RIGHTS, REMEDIES, AND OBLIGATIONS. THEY INCLUDE VARIOUS LIMITATIONS AND EXCLUSIONS, A CLAUSE THAT GOVERNS THE JURISDICTION, VENUE, AND GOVERNING LAW OF DISPUTES, AND OBLIGATIONS TO COMPLY WITH APPLICABLE LAWS AND REGULATIONS.

1. Introduction
1.1 About TuRide
TuRide Inc. ("TuRide," "we," "us," or "our") provides an online peer-to-peer vehicle sharing platform that connects vehicle owners ("Hosts") with travelers and locals seeking to rent those vehicles ("Renters" or "Guests"). The TuRide platform is accessible online at turide-inc.com. The TuRide website and associated services are collectively referred to as the "Services."
1.2 Service Scope
TuRide operates exclusively within the Dominican Republic. Our platform supports the rental of the following vehicle types:
- Cars (sedans, SUVs, trucks, etc.)
- ATVs (All-Terrain Vehicles)
- Scooters (motorized scooters and mopeds)
- Buggies (dune buggies and side-by-sides)
1.3 Agreement
By accessing or using the Services, including by communicating with us or other TuRide users, you agree to comply with and be legally bound by these Terms of Service (these "Terms"), whether or not you become a registered user of the Services. These Terms govern your access to and use of the Services and constitute a binding legal agreement between you and TuRide.
These Terms, together with our Cancellation Policy, Privacy Policy, and all other policies referred to herein (collectively, the "Policies"), constitute the "Agreement" between you and TuRide. TuRide acts as the intermediary for transactions between Renters and Hosts.
1.4 Definitions
- "Host": A registered user who lists one or more vehicles for rental on the Services.
- "Renter" or "Guest": A registered user who books a vehicle through the Services.
- "Vehicle": Any car, ATV, scooter, buggy, or other eligible vehicle listed on the Services.
- "Trip" or "Reservation": A confirmed booking of a Vehicle for a specified period.
- "Approved Driver": A Renter or any additional driver listed in the trip details who is authorized to operate the Vehicle.
1.5 Modification of Terms
TuRide reserves the right, at our sole discretion, to modify the Services or these Terms at any time. If we modify these Terms, we will post the modification on the Services and update the "Last Revised" date at the top of these Terms. If you continue to access or use the Services after we have posted a modification, you are indicating that you agree to be bound by the modified terms. If the modified terms are not acceptable to you, your sole recourse is to stop using the Services and close your TuRide account.
2. Eligibility, Registration, and Verification
2.1 Eligibility Requirements
For Renters (Guests):
- You must be at least 18 years old to rent a vehicle through the Services.
- You must possess a valid driver's license appropriate for the type of vehicle you wish to rent.
- You must meet any additional eligibility requirements specified by the Host or required by applicable law.
For Hosts:
- You must be at least 21 years old to list a vehicle on the Services.
- You must be the legal owner of the vehicle or have all necessary rights and permissions to share the vehicle for compensation.
- You must maintain valid registration and insurance for any vehicle you list.
2.2 Account Registration
To access certain features of the Services, you must create a TuRide account. When registering, you must provide accurate, current, and complete information, including:
- Full legal name
- Email address
- Mobile phone number
- Valid payment method
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify TuRide of any unauthorized use of your account.
2.3 Dual Roles
Users may act as both Hosts and Renters on the platform. When acting in either capacity, you must comply with all applicable terms and responsibilities for that role.
3. Identity Verification and Document Approval
3.1 Verification Requirements
TuRide implements identity verification and document approval to establish trust and safety within our community. All documents must be approved by a TuRide moderator before certain actions can be completed.
For Renters:
- You must upload a valid driver's license for verification before completing your first booking.
- Your driver's license must be current, legible, and appropriate for the type of vehicle you wish to rent.
- Approval of your driver's license is required before you can complete any booking.
For Hosts:
- You must upload a valid government-issued identification document (e.g., national ID card, passport) when registering as a Host.
- For each vehicle you list, you must upload:
- Vehicle registration documents
- Proof of valid insurance coverage
- Clear photographs of the vehicle
- All documents must be approved by a TuRide moderator before your listing goes live.
3.2 Document Accuracy
You represent and warrant that all documents and information you provide are accurate, authentic, and not falsified. Providing false or misleading documents may result in immediate account termination and may be reported to appropriate authorities.
3.3 Third-Party Verification
TuRide may use third-party services to verify the information you provide and to obtain additional related information. By using the Services, you authorize TuRide to request, receive, use, and store such information.
3.4 Right to Refuse
TuRide reserves the right to refuse or revoke your ability to book or list vehicles at our sole discretion, including but not limited to cases where verification cannot be completed satisfactorily.
4. Fees, Taxes, and Payments
4.1 Service Fees
TuRide charges service fees for the use of the platform. The fees will be clearly itemized at checkout for Renters and displayed in the Host dashboard for Hosts.
- Renter Service Fee: A percentage of the booking total, displayed before you confirm your reservation.
- Host Service Fee: TuRide retains [COMMISSION_PERCENTAGE]% of each booking as a platform commission. Hosts receive the remaining balance.
4.2 Multi-Currency Support
TuRide supports multiple currencies to accommodate our diverse user base:
- Dominican Peso (DOP): Local currency
- US Dollar (USD): Primary tourist currency
- Euro (EUR): European currency
Hosts set their prices in their preferred currency. Renters can view prices in their preferred currency, with conversion rates updated regularly. The final charge may vary slightly due to exchange rate fluctuations.
4.3 Payment Processing
When you provide TuRide with a payment method, you authorize TuRide (or our third-party payment processors) to store your payment credentials and charge your payment method for:
- Trip costs and service fees
- Security deposits (if applicable)
- Damage claims and related costs
- Late fees or penalties
- Any other amounts owed under these Terms
4.4 Refunds
Refunds are processed according to our Cancellation Policy. If we attempt to issue a refund and the original payment method is no longer accessible, we may issue travel credit instead.
4.5 Taxes
You are responsible for determining and fulfilling your own tax obligations. TuRide may be required to collect and remit certain taxes on your behalf in accordance with applicable law. Any taxes collected will be clearly displayed in your transaction details.
4.6 Collection of Amounts Due
TuRide reserves the right to employ all legal methods available to collect amounts due, including engaging collection agencies. Failure to pay may result in additional fees and may be reported to credit bureaus where permitted by law.
5. Host Responsibilities
5.1 Vehicle Condition and Safety
As a Host, you commit to providing a safe, legally registered, and properly insured vehicle. Specifically, you must ensure that:
- The vehicle is in safe and operable mechanical condition.
- The vehicle has a clean title (non-salvaged, non-branded).
- The vehicle is free from any safety recalls, or all recall repairs have been completed.
- The vehicle meets all applicable inspection and registration requirements.
- The vehicle is roadworthy and complies with all applicable laws.
5.2 Insurance Requirements
You must maintain valid liability insurance coverage for any vehicle you list on the Services. This insurance must:
- Meet or exceed the minimum insurance requirements under Dominican Republic law.
- Cover the vehicle during rental periods.
- Be current and valid at all times the vehicle is listed.
You must provide proof of insurance as part of the document verification process.
5.3 Accurate Listings
You must ensure that your vehicle listings are complete, accurate, and up-to-date, including:
- Vehicle make, model, year, and specifications
- Accurate photographs of the current condition
- Available features and any limitations
- Pricing and availability
- Pick-up location(s) and delivery options (if offered)
You must honor the price quoted to a Renter and may not cancel a booking to seek a higher price.
5.4 Delivery Options
If you offer vehicle delivery, you must:
- Clearly specify delivery areas and any associated fees in your listing.
- Deliver the vehicle on time and to the agreed location.
- Ensure the vehicle is in the condition described in your listing upon delivery.
- Arrange for vehicle return or pick-up as agreed with the Renter.
5.5 Usage Area Restrictions
You may define a geographic usage area within which your vehicle must be operated (the "Usage Radius"). If you set a Usage Radius:
- You must clearly specify the permitted usage area in your listing.
- You must inform the Renter of any geographic restrictions before the trip begins.
- The Usage Radius must be reasonable and clearly defined (e.g., within a specific city, region, or distance from the pick-up location).
- You may set different usage areas for different vehicle types based on their intended use (e.g., off-road vehicles limited to specific areas).
Renters who operate vehicles outside the defined Usage Radius may be held liable for any resulting damages, violations, or penalties.
5.6 Availability and Commitments
Once a booking is confirmed, you must make the vehicle available as scheduled. If you offer the Renter the option to pick up the vehicle at a specified location, you must ensure the vehicle is available at that location at the start of the reservation.
5.7 Driver's License Verification
Before releasing your vehicle to a Renter, you must verify that the Renter has a current, valid driver's license that matches the name on the reservation.
5.8 Damage Reporting
If you believe a Renter has caused damage to your vehicle, you must report that damage as soon as you become aware of it, and no later than 24 hours after the scheduled end of the trip. Follow the damage reporting process on the TuRide website.
6. Renter Responsibilities
6.1 Driver's License and Identification
As a Renter, you must:
- Possess and present a current, valid driver's license appropriate for the vehicle type.
- Ensure your driver's license has been verified and approved through the TuRide platform.
- Present your driver's license to the Host upon vehicle pick-up.
6.2 Vehicle Care
You must treat the vehicle with reasonable care and return it:
- On time and to the agreed location
- In essentially the same condition as received
- With the same fuel level as received (unless otherwise agreed)
- Free of excessive dirt or debris
6.3 Approved Drivers Only
You may not allow anyone other than Approved Drivers listed in the trip details to operate the vehicle. You are responsible for the actions of all Approved Drivers.
6.4 Safe Operation
You must:
- Operate the vehicle safely and in compliance with all applicable laws.
- Obey all traffic laws, including speed limits.
- Not operate the vehicle while impaired by alcohol, drugs, or any substance.
- Not operate the vehicle while using a mobile phone or otherwise distracted.
- Use all required safety equipment appropriate for the vehicle type, including but not limited to:
- Cars and Buggies: Seat belts for all occupants
- Scooters and ATVs: Helmets for all riders
- Any other safety equipment required by law or provided by the Host
- Comply with all child safety requirements applicable to the vehicle type.
- Ensure all passengers use the appropriate safety equipment for the vehicle.
6.5 Usage Area Compliance
If the Host has specified a Usage Radius or geographic restriction for the vehicle, you must:
- Operate the vehicle only within the permitted usage area as defined in the listing.
- Not take the vehicle outside the designated boundaries without prior written consent from the Host.
- Be aware that certain vehicles (e.g., buggies, ATVs) may have specific area restrictions based on their intended use.
Violation of Usage Radius restrictions may result in:
- Full liability for any damages, accidents, or incidents occurring outside the permitted area.
- Voiding of any applicable insurance coverage.
- Additional fees or penalties.
- Termination of your TuRide account.
6.6 Prohibited Uses
You must not:
- Use the vehicle for any illegal purpose.
- Use the vehicle for commercial purposes (e.g., ridesharing, delivery services) unless expressly permitted.
- Transport more passengers than the vehicle is designed to carry.
- Transport hazardous materials.
- Take the vehicle outside of the Dominican Republic without express written consent.
- Operate the vehicle outside the Host's designated Usage Radius (if specified).
- Participate in races, speed tests, or off-road driving (unless the vehicle is designed for off-road use and this is permitted in the listing).
- Smoke in the vehicle (unless expressly permitted by the Host).
- Allow pets in the vehicle (unless expressly permitted by the Host).
- Leave the vehicle unlocked, running, or with keys unsecured.
6.7 Incident and Damage Reporting
You must immediately report to TuRide:
- Any damage to the vehicle
- Any accident or collision
- Any theft or attempted theft
- Any mechanical issues or breakdowns
In the event of an accident, you must also file a police report and cooperate fully with any investigation.
6.8 Vehicle Inspection
You should conduct a visual inspection of the vehicle before starting your trip. If you find pre-existing damage, photograph it and report it through the TuRide website immediately to avoid being held responsible for that damage.
7. Booking and Cancellation
7.1 Booking Process
To book a vehicle:
- Search for available vehicles based on your location, dates, and vehicle type preferences.
- Review the listing details, including pricing, features, and Host policies.
- Submit a booking request or instant book (if available).
- Once confirmed, you will receive booking confirmation with trip details.
7.2 Delivery and Pick-Up Options
Pick-Up: Renters may pick up vehicles at the location specified in the listing or as agreed with the Host.
Delivery: Some Hosts offer vehicle delivery for an additional fee. If delivery is available:
- Delivery locations and fees will be specified in the listing.
- Coordinate delivery time and location with the Host through the TuRide messaging system.
- Inspect the vehicle upon delivery and report any issues immediately.
7.3 Cancellation Policies
Host-Defined Cancellation Policy: Each Host sets their own cancellation policy for their vehicle listings. Cancellation policies may vary from Host to Host and may include:
- Flexible policies: Full or partial refunds for cancellations made within a specified timeframe.
- Moderate policies: Partial refunds with specific conditions.
- Strict policies: Limited or no refunds for cancellations.
Renter Obligations:
- The Host's cancellation policy is clearly displayed on each vehicle listing.
- By completing a booking, you agree to be bound by the Host's cancellation policy for that reservation.
- You are responsible for reviewing and understanding the cancellation policy before confirming your booking.
- Refunds, if any, will be processed according to the Host's stated policy.
Host Cancellations:
- Hosts should avoid cancelling confirmed bookings.
- Host cancellations may result in penalties, including reduced visibility in search results and potential account restrictions.
- Renters will receive a full refund for any booking cancelled by the Host.
TuRide Service Fees: TuRide service fees may or may not be refundable depending on the circumstances of the cancellation. TuRide reserves the right to retain service fees in cases of Renter cancellation.
TuRide does not intervene in or override the Host's cancellation policy. All cancellation matters are governed solely by the policy set by the Host.
7.4 No-Shows
Renter No-Show: If you fail to pick up the vehicle or meet the Host at the agreed time and location without prior notice, you may forfeit the entire booking amount.
Host No-Show: If the Host fails to make the vehicle available as agreed, you will receive a full refund and TuRide will assist in finding an alternative vehicle if possible.
7.5 Trip Modifications
Modifications to existing bookings (dates, times, location changes) must be requested through the TuRide platform and are subject to Host approval and availability. Additional fees may apply.
8. Insurance and Liability
8.1 Basic Liability Insurance
Hosts are required to maintain basic liability insurance coverage for their vehicles as a condition of listing on TuRide. This Host-provided insurance serves as the baseline protection for rental activities.
Host Obligations:
- Maintain valid liability insurance that meets or exceeds Dominican Republic legal requirements.
- Ensure coverage remains active throughout all rental periods.
- Provide proof of insurance during the verification process.
8.2 Optional Full Coverage Insurance
TuRide facilitates access to optional third-party full coverage insurance that Renters may purchase to enhance their protection during a trip. This optional coverage may include:
- Collision damage waiver
- Theft protection
- Third-party liability coverage
- Personal accident coverage
Important: The optional insurance is provided by third-party insurance partners, not by TuRide directly. TuRide acts solely as a facilitator to connect users with insurance options. The specific terms, conditions, coverage limits, and exclusions are determined by the insurance provider.
8.3 TuRide's Role
TuRide is not an insurance company and does not underwrite or provide insurance directly. TuRide:
- Requires Hosts to maintain basic liability insurance.
- Facilitates access to optional third-party insurance for Renters.
- Does not guarantee coverage or claims outcomes.
- Is not responsible for the acts or omissions of insurance providers.
8.4 Renter Liability for Damages
The Renter who booked the trip is financially responsible for:
- All physical damage to the vehicle that occurs during the trip.
- Theft of the vehicle during the trip.
- Additional costs resulting from damage (e.g., loss of use, administrative fees).
This responsibility applies regardless of fault, unless covered by applicable insurance.
8.5 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- TuRide provides the Services "as is" without warranty of any kind.
- TuRide is not responsible for the safety, roadworthiness, or legal status of any vehicle.
- TuRide is not responsible for the actions of Hosts, Renters, or any third parties.
- TuRide is not liable for any indirect, incidental, special, consequential, or punitive damages.
- TuRide's total liability shall not exceed the greater of: (a) the fees you paid to TuRide in the 12 months before the claim, or (b) USD $100.
8.6 Indemnification
You agree to indemnify, defend, and hold harmless TuRide and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of:
- Your use of the Services
- Your violation of these Terms
- Your interaction with other users
- Your booking or listing of a vehicle
9. Prohibited Activities
You agree that you will not, nor will you assist any third party to:
9.1 Violate Laws or Regulations
- Breach any local, national, or international law or regulation.
- Violate any order of a court.
- Evade tax obligations.
- Infringe upon intellectual property rights.
9.2 Provide False Information
- Submit false, inaccurate, or misleading information.
- Create an account under a false identity.
- Provide falsified documents.
- Misrepresent yourself, your qualifications, or your vehicles.
9.3 Harm the TuRide Community
- Harass, threaten, or abuse other users.
- Discriminate against any user based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Collect personal information about other users without consent.
- Interfere with other users' listings or bookings.
9.4 Circumvent the Platform
- Complete transactions outside of the TuRide platform to avoid fees.
- Contact users for purposes unrelated to a booking.
- Recruit users to competing platforms.
- Artificially inflate prices or manipulate listings.
9.5 Interfere with Services
- Distribute viruses, malware, or harmful code.
- Attempt to probe, scan, or test system vulnerabilities.
- Scrape, crawl, or systematically retrieve data from the Services.
- Interfere with the operation of the Services.
- Circumvent account suspensions or terminations.
9.6 Geographic Restrictions
- Use the Services for vehicles located outside the Dominican Republic.
- Take rented vehicles outside the Dominican Republic without express written consent.
10. Content and Intellectual Property
10.1 TuRide Content
All content on the Services, including text, graphics, logos, images, and software, is the property of TuRide or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without express written consent.
10.2 User Content
By posting content on the Services (such as photographs, reviews, and descriptions), you grant TuRide a worldwide, royalty-free, perpetual license to use, copy, modify, display, and distribute that content for purposes of operating and promoting the Services.
You represent that you own or have the rights to post any content you submit, and that such content does not violate any third party's rights.
10.3 Reviews and Feedback
Users may leave reviews and ratings after completed trips. Reviews must be honest, accurate, and based on genuine experiences. TuRide may remove reviews that:
- Contain false or misleading information
- Include offensive or inappropriate content
- Violate these Terms or applicable law
- Are believed to be fraudulent or manipulated
11. Dispute Resolution
11.1 Governing Law
These Terms and the Agreement shall be governed by and construed in accordance with the laws of the Dominican Republic, without regard to conflict of law principles.
11.2 Jurisdiction
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved exclusively in the courts of the Dominican Republic. You agree to submit to the personal jurisdiction of such courts.
11.3 Dispute Resolution Process
Step 1: Direct Resolution We encourage you to first contact us directly to seek resolution. You may reach us at support@turide-inc.com with a description of your concern.
Step 2: User-to-User Disputes For disputes between Hosts and Renters (e.g., damage claims, cancellation disputes), TuRide may, at its discretion, assist in mediating a resolution. TuRide's decisions on such matters are final but TuRide is not obligated to intervene in every dispute.
Step 3: Formal Legal Action If a dispute cannot be resolved through the above steps, either party may pursue legal action in accordance with Section 11.2.
11.4 No Class Actions
To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.
12. Termination
12.1 Termination by You
You may terminate your TuRide account at any time by contacting us at support@turide-inc.com. Termination does not release you from any obligations incurred prior to termination, including:
- Outstanding payments
- Pending claims
- Ongoing trips
12.2 Termination by TuRide
TuRide may suspend or terminate your access to the Services at any time, with or without cause, including but not limited to:
- Violation of these Terms
- Fraudulent or illegal activity
- Providing false information
- Failure to pay amounts owed
- Receiving multiple negative reviews or complaints
- At TuRide's sole discretion
12.3 Effect of Termination
Upon termination:
- Your right to use the Services ceases immediately.
- You remain liable for all fees and obligations incurred prior to termination.
- TuRide may retain your information as permitted by our Privacy Policy and applicable law.
- Provisions of these Terms that by their nature should survive termination shall survive (including limitations of liability, indemnification, and dispute resolution).
13. General Provisions
13.1 Entire Agreement
The Agreement, including these Terms and all referenced Policies, constitutes the entire agreement between you and TuRide concerning your use of the Services and supersedes all prior agreements or understandings.
13.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13.3 No Waiver
The failure of TuRide to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
13.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without TuRide's prior written consent. TuRide may assign its rights and obligations without restriction.
13.5 Communications
You agree that TuRide may communicate with you electronically, including by email, SMS, or messages within the Services. You agree that such electronic communications satisfy any legal requirements for written communications.
13.6 Translations
These Terms may be translated into other languages for your convenience. In case of any discrepancy between the English version and any translation, the English version shall prevail, except where prohibited by applicable law.
13.7 Not a Rental Car Company
TuRide is not a rental car company. TuRide does not own vehicles and is not in the business of renting vehicles. TuRide provides an online platform where vehicle owners and those seeking vehicles can connect and transact.
13.8 Independent Contractors
Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between TuRide and any user. Hosts and Renters are independent parties, not employees or agents of TuRide.
13.9 Force Majeure
TuRide shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, war, terrorism, or internet service disruptions.
